Supreme Court Ruling on ADC Not Final, Says Maduabuchi
A Senior Advocate of Nigeria, Oba Maduabuchi, has said the recent Supreme Court decision involving the African Democratic Congress does not resolve the underlying dispute and should not be a cause for celebration.
Speaking during an interview on Arise News TV, Maduabuchi argued that the case ought not to have reached the apex court, maintaining that there was no appealable ruling from the Federal High Court.
He criticised the Court of Appeal for exceeding its jurisdiction by issuing an order that was not sought by any of the parties, despite correctly determining that there was no valid appeal filed by the faction linked to David Mark.
According to him, the appellate court erred by directing that the status quo be maintained, instead of restoring the situation as it existed before the dispute. He explained that the distinction between maintaining the status quo and the status quo ante was critical in the matter.
Maduabuchi further stated that the Independent National Electoral Commission acted appropriately when it removed David Mark, in compliance with the appellate court’s directive.
He maintained that the legal issues surrounding the dispute remain unresolved despite the Supreme Court’s involvement.
