You are Violating Constitutional Order, NBA Carpets Rivers Sole Administrator

The Nigerian Bar Association (NBA), Port Harcourt Branch, has criticized the conduct of Vice Admiral Ibok-Ete Ibas (rtd), the Sole Administrator of Rivers State, accusing him of violating the constitution and undermining democratic governance.

In a press statement signed by the 8 Branch Chairmen, the NBA expressed deep concern over recent developments in the state, particularly the suspension of elected state officials and the Sole Administrator’s recent appointments.

The lawyers’ body described these actions as unlawful, provocative, and injurious to democratic institutions.

The NBA unequivocally condemned the Sole Administrator’s actions, stating that they violate the spirit and letters of the Constitution of the Federal Republic of Nigeria, 1999 (as amended). The association emphasized that it cannot remain silent while the constitutional order is brazenly disregarded, as this poses a threat to Nigeria’s democratic experiment.

The NBA also drew attention to the alleged harassment and intimidation of citizens, especially those who have criticized the state of emergency or attempted to protest peacefully.

The association warned that unchecked overreach by appointed administrators could erode public trust in governance and the legal system.

The NBA therefore has called on President Bola Tinubu to intervene in the situation, demanding an immediate review and reversal of the emergency governance framework in Rivers State.

The association urged the reinstatement of Governor Siminalayi Fubara and other duly elected officials, stating that the people’s mandate must be respected.

The NBA reminded the Federal Government and relevant institutions that the democratic will of the people is sacrosanct and must be respected. The association reiterated its commitment to democratic values, constitutionalism, and the peaceful resolution of conflicts, warning that any attempt to legitimize or normalize administrative actions that override the constitution could set a dangerous precedent for governance across the country.

As political tensions continue to rise in Rivers State, the NBA’s position signals a growing resistance from civil society and professional bodies, all of whom are raising the alarm over the gradual erosion of democratic norms. The association’s statement serves as a call to action, urging the government to uphold the rule of law and respect the democratic will of the people.
